Olympus, whistleblower reach settlement in Britain

TOKYO (AP) ? Olympus Corp. has reached a settlement with whistleblower Michael Woodford who had been suing over his dismissal as chief executive of the Japanese camera maker.

Woodford, a Briton, was fired in October after he blew the whistle on dubious accounting at Olympus. The Tokyo-based company has acknowledged it hid 117.7 billion yen ($1.5 billion) in investment losses dating back to the 1990s.

Terms of the deal reached Tuesday were not disclosed as a condition of the settlement, both sides said. The company said Wednesday its board must also sign off on the settlement.

"Hopefully today is a closer. A line has been drawn, and the company can move on and I can," Woodford told reporters in London.

The case had been set to go before a British employment court Monday, but that got delayed.

Woodford said a board meeting was set for June 8, but Olympus declined to confirm that. Woodford said he could not give details of the agreement.

Woodford, a rare foreigner to lead a major Japanese company and the first at Olympus, has conceded he has given up on any comeback at the camera and medical equipment maker.

Three former Olympus executives, including the company's ex-chairman, were arrested earlier this year on suspicion of orchestrating the cover-up. The company has carried out its own investigation and is suing some executives for damages.

Woodford has been praised by some Japanese as courageous in bringing dubious old-guard company practices to light. Others have criticized his methods as too confrontational. He has appeared often on Japanese media, and the public response has been overwhelmingly warm.

Right Sizing Your Homes Heating & Cooling System ? Diet and ...

JaneneSedenko276

Categories: Uncategorized

The chances are pretty good that the furnace and/or the air conditioner you have in your home is oversized. This is not merely a random assumption; there have been several national surveys conducted that have found that more than half of all HVAC contractors do not take the proper steps to size heating and cooling systems appropriately. The most common mistake with sizing is over-sizing.

Bigger is NOT Better?
Having an oversized system poses many problems. An oversized system runs quite inefficiently. Not only does this cost you more to operate, but oversized system create temperature swings that can make your home feel uncomfortable. It is unfortunate, but most homes today are heated and cooled by equipment that is too big for the home? and when an air conditioner or heat pump system is not the proper size for a home, an array of problems can result: Temperatures might be uneven. Equipment might not run long enough to properly control humidity. Equipment that is not running at peak performance often encounters more maintenance problems over time. And the money you think you might be saving may be reduced, because with equipment that is too big, youre essentially paying to heat or cool space that isnt there. In addition to wasted energy and uncomfortable temperature swings, improperly sized equipment can lead to humid conditions that can cause to mold growth and promote dust mite growth. Sensitive groups of people who suffer with allergies or asthma can really be troubled by these conditions.

To understand how a heating or cooling system should be sized, it is first important to understand incorrect sizing methods. Most installers do nothing more than check the label on your existing unit that states the BTU output per hour. Then, he or she simply sells you a comparable sized option, or even worse, one that is larger! In many cases, the installer may use oversimplified rules of thumb that follow arbitrary guidelines. These are absolutely unacceptable ways to size a system because they do not consider many issues your exact home may contain (such as air flow, number of occupants, insulation types, glazing, solar orienationetc.). The problem with using the current system size as a guide is that many existing homes have systems that are very oversized to begin with ? sometimes by as much as two to four times. Most homeowners make improvements to their home over the course of years. New windows, doors, insulation, weather stripping, and caulking make the home more efficient. This means you may not need the same sized heating or cooling system that was originally installed when the home was constructed.

The correct way to size a heating or cooling system is to the sizing standard developed by the Air Conditionion Contractors Association (ACCA) called Manual-D for duct design and Manual-J for heat loss and equipment sizing. It is imperative that homeowners choose a contractor that utilizes these methods prior to agreeing to any new system installation. If you are also considering having a new duct system installed your contractor should make use of manual D guidelines. If you are uncertain as to whether or not your contractor used one of these methods, or if you just want a bit of verification that the calculations are correct, do not hesitate to get a second opinion.

hello, my wife has brain cancer for the 2nd time. looking for input ...

Hello, my wife was diagnosed with a brain tumor in 2001, underwent surgery, chemo, radiation. She survived and has lived a pretty normal life until a year ago. She started having trouble with her right arm and leg. Therapy wasnt working so her doc sent her for an MRI. The cancer was back with a vengance. She started out taking tremadar but it didnt help, she is now on E7080 a clinical trial med. She has lost her ability to do anything on her own. Can only use her left hand to work the remote for the tv, feed herself and grab a drink. She cant talk other than gestures with her hand and make a few grunts for yes and no. I am pretty much her 24/7 care taker. Give her baths, help her go potty. Pretty much everything. I have help here to assist with our daughter and things around the house. I used to drive an 18 wheeler but hired a driver to drive our truck so i could stay home to take care of her. At first it wasnt too bad, but here recently she has gotten worse and worse. We are thinking of putting her in a nursing home. I just dont know which direction to turn. what to do. Not many peopleto talk to about it. So I found this group thingy. Maybe I can get some input from someone who has been thru this. Or maybe I cant give some in return to anyone thats fixing to go thru this.

Insight: U.S. hedge funds find ways to trade euro misery

BOSTON/NEW YORK (Reuters) - Two decades ago, George Soros rose to fame and fortune on his now-historic trade in which he took on the Bank of England and shrewdly wagered on a devaluation of the British pound.

But it's unlikely the current European monetary crisis and worries about Greece's potential exit from the euro zone will give rise to an investing legend like Soros, who made $1 billion in 1992 by betting on a decline in the price of the pound.

Instead, there are a multitude of strategies to play Europe's troubles, and many different participants, according to U.S. hedge fund managers.

"There is not room for one player to have such impact," said John Brynjolfsson, whose California-based Armored Wolf hedge fund has been betting against the euro for quite some time. "Financial markets are so much bigger today."

A spokesman for Soros, who last year converted his Soros Fund Management to a family office and stopped managing money for outside investors, could not be reached for comment.

Brynjolfsson and several other U.S. money managers who are trying to profit from Europe's misery say they expect the current crisis to produce a lot of winners.

So far this year, the euro is down 3.3 percent against the U.S. dollar.

U.S. money managers say it's hard to swing for the fences the way Soros did because institutional investors are far more squeamish about having too much money riding on any single trade. There is also heightened sensitivity from pensions and endowments to taking an investment strategy that might spark political outrage from European leaders.

Another thing working against the rise of a new Soros is that trading the euro zone, or even the fallout from a Greek exit, is a much more complicated than betting against a single currency.

Money managers are playing the euro zone crisis by trading currencies, wagering on the direction of bank stocks or using derivatives like credit default swaps to bet on potential corporate and bank failures. Greenlight Capital's David Einhorn recently said he is bullish on gold and gold miners, in part because of concern about the fallout from a euro zone meltdown.

Some managers are even going both short and long on different European sovereign debt, depending on their views of the financial stability of different countries.

Adam Fisher, manager of the $320 million Commonwealth Opportunity Capital hedge fund, noted that Soros faced a "single country, not 17 different countries, one decision maker, not 17."

Fisher's fund, which has more than 80 percent of its money invested in Europe, is taking a somewhat contrarian position by owning the European sovereign debt of Germany, the Netherlands, Italy and Spain.

Hedge fund managers point out that given the up-and-down nature of the euro zone crisis, most hedge funds have been in and out of trades or forced to adjust positions depending on the changing political winds.

Earlier this year, for instance, it looked like concern about Greece exiting the euro had passed. But with the recent results of the Greek election at odds with the austerity measures demanded by its currency partners, the risk of a Greek departure from the euro zone has risen dramatically.

Recently, Fisher said his Los Angeles-based fund had reduced the size of some of its more bullish sovereign debt trades because he believes there will be "violent" market swings this summer.

"It is going to be incredibly difficult to manage risk through that environment," said Fisher, whose fund was up 8.8 percent through April. "I don't think hedging will do anything. The way you hedge, is you sell. You don't subtract risk by adding risk."

Brynjolfsson, a former top portfolio manager for bond mutual fund firm Pacific Investment Management Co, is betting on Greece exiting the euro. He said it will be hard for European leaders to take the necessary steps to appease the Greek government without infuriating politicians in other euro zone countries.

"As the wheels began falling off the bus, we adjusted to have a short bias and that has worked out," said Brynjolfsson, whose $750 million hedge fund is up 2 percent this year, largely on its short bet against the euro.

Axel Merk, president and chief executive officer of Merk Investments, an investment advisory firm that specializes in currencies, said the growing problems with Greece and the euro zone led him recently to dump all the euros in his $517 million Merk Hard Currency Fund, which is up 2.29 percent for the year.

Merk now favors the Singapore dollar, which has climbed 1.34 percent since January.

Ray Dalio's $120 billion Bridgewater Associates gained 23 percent in 2011 in part because of profits made from a series of European bets, said a person familiar with the Westport, Conn.-based fund who declined to discuss specifics of the strategy. In a recent interview with Barron's, Dalio said European banks "are now over-leveraged and can't expand their balance sheets" and European nations "don't have enough buyers of their debt."

Dalio may be the U.S. money manager who comes closest to rivaling the Soros of two decades ago. His hedge fund is the industry's largest and he widely regarded as one of the most successful managers.

Among the ways funds are playing the European turmoil, some are betting against the fortunes of Spanish and Italian banks instead of simply focusing on sovereign debt.

John Paulson, among others, bets against European sovereign debt as way to hedge the overall portfolio of his Paulson & Co hedge fund firm.

Daniel Loeb's Third Point fund put on a long position in Portuguese sovereign bonds in the first quarter because the New York-based manager believed the nation is in better shape than others in the euro zone.

"Portugal's debt profile is more consistent with Italy's than Greece's, its banks are substantially healthier than Spain's, and its government has enacted more aggressive labor reforms and is more stable than regimes in both countries," Loeb wrote in a May 16 investors' letter seen by Reuters.

If nothing else, the European crisis is forcing managers to keep coming up with new strategies to trade. One might say it's almost become an incubator for hedge fund managers to stretch their investment acumen.

Merk said he might look again at Europe if the political and financial situation gets more clarity. But he would likely do it a bit differently.

"If there is clarity in the process again, then we will certainly look at Europe again," he said. "But not through Greek debt, but through German bills."

Your Current Rating's Relevancy To Loan Providers | Rox Art News

Finance scores are in essence an individual's analysis on their means to conscientiously manage consumer debt. Personal loan providers need credit statements together with credit ratings models to review the risks of providing funds to customers. Consumers who've proven a sturdy and unfailing record of responsible getting finance and payment would probably receive larger funding values in addition to more favorable interest rates and conditions in comparison with credit seekers who have failed to fulfill loan responsibilities habitually and in full.

Consumer credit rankings are actually based upon a selection of scoring elements which help show to the lender exactly what type of borrower a consumer has actually demonstrated to be in times past. Items that impact ones consumer credit rating comprise of personal loan history, finance-to-balance proportions, prompt monthly payments, CCJs, revenue, and even more. Firms are actually in the business of lending capital. All the same, ahead of lending to a prospect, the loan service definitely wants to identify the associated risk to benefit ratio delivered by funding the customer's personal loan desires. The lesser the financial risk the debtor poses, the greater the bargaining ability she or he has. Folks with adverse credit are largely at the mercy of the loan provider regarding whether they are able to obtain funding, and also whether it'll be granted with acceptable settlement terms and annual percentage rates. In most instances, below average credit clients pay back a lot more.

Regretably, a number of individuals happen to be uneducated when it comes to the manner in which consumer credit rankings are identified. Generally customers and prospects get going with forming their particular credit score very early in their adult life, long before a lot of them are primed for the accountability. Less mature men and women tend to be ignorant regarding exactly how appreciably their own personal financial circumstances are affected because of having bad or good credit scores. It is not important for many folks right up till it will come the moment in time to buy a house and / or an auto, and that is when a visit to a bad credit score provider will be advantageous.

An applicant in need of a mortgage loan on a new house might possibly find remarkably differing mortgage offers dependent on if she has a first-rate or unfavorable rating. Persons that have impressive credit ratings may come across decreased upfront credit expenses. Also they are very likely to acquire a superior rate of interest for their financing. Even a half to one full percentage point of interest charges for an everyday property finance loan can result in an enormous financing impact.

During the lifespan of home financing, a consumer could potentially save themselves thousands in interest fees by just gaining one half to 1 percent better charge on the home owner loan. Stipulations are almost always far more advantageous to boot. It all relates to negotiating capacity. A consumer with a positive credit rating will be empowered to negotiate confidently with personal loan companies since he offers very low associated risk. A borrower with unfavorable credit ratings discovers much less options of willing and able loan product companies and has minimized negotiating potential.

Martin writes for ADM Online who offer loans to UK residents with good or poor credit ratings.

Japan: Americans held in Irish student's death

From Junko Ogura, CNN

May 27, 2012 -- Updated 0527 GMT (1327 HKT)

STORY HIGHLIGHTS

  • Nicola Furlong, 21, is found dead in a hotel room with one of the men, police say
  • Police detain the Americans for questioning into Furlong's death
  • The death is believed to be a result of strangling

Tokyo (CNN) -- Police have detained two American men as part of an investigation into the strangling death of an Irish exchange student in Tokyo, local authorities said Sunday.

Nicola Furlong, 21, was found dead in a hotel room with one of the men, according to Tokyo police.

The men were not charged in Furlong's death. Rather, police arrested the men, ages 19 and 23, on suspicion of improperly touching Furlong's friend in a taxi early Thursday, as the four were headed back to the hotel, authorities said.

Authorities would not say how the four ended up together, but Japanese media reported that the women were attending a concert in Tokyo when they met the men and decided to accompany them to their hotel rooms.

The hotel staff found Furlong unconscious after customers complained of loud noises coming from the room, police said.

When the staff got to the room, they found her in the room with the 19-year-old and called the fire department, Tokyo authorities said.

The death is believed to be as a result of suffocation by the cervical compression, police said.

The U.S. State Department confirmed the arrests, but could not provide additional details, citing privacy concerns.

CNN's Jamie Crawford and Bharati Naik contributed to the report.

Egypt's two contenders for president vie for votes

CAIRO | Sun May 27, 2012 7:35am EDT

CAIRO (Reuters) - The two apparent survivors in Egypt's presidential race tried to gather support on Sunday from voters dismayed at what many see as a painful second-round choice between an Islamist apparatchik and a throwback to Hosni Mubarak's era.

Both men are seeking to soften those images, lay claim to the mantle of the "revolution" that toppled Mubarak 15 months ago, and appeal to the many Egyptians who picked more centrist figures in last week's first round.

Hatem Begato, head of the electoral committee, said it was considering complaints about the voting filed by four candidates - second-placed Ahmed Shafiq, who was Mubarak's last prime minister, leftist Hamdeen Sabahy, moderate Islamist Abdel Moneim Abol Fotouh and former Arab League chief Amr Moussa.

"The (election) results will be announced on Monday or Tuesday at the latest," Begato told Reuters by telephone.

Figures cited by state media and party campaigns put Mohamed Mursi, an obscure Brotherhood insider, in a likely runoff with Shafiq, a bluff ex-air force chief who has sworn to restore security.

But Sabahy, who came a close third, challenged his placing. "We have information that conscripts voted illegally," he told a raucous crowd of supporters in Cairo late on Saturday.

The polarized outcome has even led to suggestions - swiftly rejected by the Brotherhood - that Mursi should withdraw to allow Sabahy to go through to the second round.

"This is unconstitutional," Essam el-Erian, a leader of the Brotherhood's Freedom and Justice Party, told Reuters, adding that if Mursi quit at this stage, Shafiq would win by default.

INVESTORS SPOOKED

The divisive turn taken by the presidential election depressed Egyptian share prices on Sunday, the first day of trading since two days of voting ended on Thursday.

"Some investors are afraid that because we now have the two extreme elements confronting one another, the coming period will not be calm," said Osama Moura, CEO at Arab Finance Brokerage.

The benchmark index had dropped 3 percent by early afternoon, heading for its biggest fall in more than a month.

The Brotherhood, which already dominates both houses of parliament after earlier elections, wants to draw rival parties into a broad front to beat Shafiq in the June 16 and 17 run-off.

"We have to organise the movement on the street with the grass roots to support the revolution because the old regime is coming back with Shafiq," said a Mursi spokesman, Yasser Ali.

"We are open-minded and open-hearted with all political groups, especially the revolutionary groups, to organise and form a coalition government, soon after Mursi becomes president."

Ali said Mursi might meet Abol Fotouh, a former Brotherhood member who came fourth in the first round, and other leaders, possibly including Sabahy, later in the day.

Shafiq is also reaching out to voters, including the young activists who despise him as a figure from the past.

"Your revolution was stolen," he said at a news conference on Saturday. "I pledge to return its fruits to your hands."

The presidential election is supposed to close an army-led transition punctuated by violence and political disputes since a popular uprising overthrew Mubarak in February last year.

The turbulence has aggravated economic problems that will loom large for any president who takes over from military rulers who took charge when Mubarak fell and are is expected to retain a strong role for years to come.

A Brotherhood victory in the presidential election could prolong a struggle with the military over the drafting of a new constitution, already mired in political disputes.

But a Mursi triumph is no foregone conclusion.

Many voters may stay away from the second round, seeing both candidates as unacceptable.

And many Christians, who make up about 10 percent of Egypt's 82 million people, are likely to swing behind Shafiq, viewing him as a bulwark against rising Islamist influence.

"The Brotherhood has not given us any assurances or promises to make us not fear for our freedoms and faith under their rule," said a Coptic church official, who asked not to be named.

Asked about Christian fears, Mursi told a television interviewer on Saturday night that "Egypt belongs to all", asking: "Who killed them in protests? Who prevented them from building churches? The old (Mubarak) regime, not us."

What the Friday: Good luck eating this 18,239-pound chocolate Mayan pyramid

You only have until December 21 to see it for yourself... whether the world is ending or not

We can't get enough of chocolate. Not only does it taste heavenly, it also?makes great dresses, vinyls, and apparently, even pyramids. Chocolate and pastry distributor,?Qzina Specialty Foods, celebrated its 30th year anniversary this 2012 by building the largest chocolate sculpture ever. At 18,239 pounds, it's more than 7,500 pounds heavier?than the previous Guinness World Record record holder. We bet not even the most hardcore chocoholic can make a large enough dent on that thing.

The humongous choco art is a replica of the?Kukulkan pyramid in Chichen Itza, an archeaological site in Yucat?n. It measures 6 feet in height and sits on a 3,000-pound, 10 feet x 10 feet base.?According to Qzina, it chose to a Mayan theme for the project because the Mayans were the first civilization to realize the awesomeness of cacao beans, and even thought of them as food for the gods.

If you want to get a glimpse (and perhaps a secret nibble) of this chocolate pyramid, head over to the?Qzina Institute of Chocolate & Pastry in Irvine, California, when it becomes available for public viewing starting June 4. And because a chocolate pyramid can't survive for thousands of years like a real one, Qzina scheduled its destruction on December 21, 2012... assuming the world doesn't end by way of a great flood, an asteroid, or a?zombie takeover first.

Is China poor? Key question at climate talks

Yuan, File)

(AP) ? Another round of U.N. climate talks closed Friday without resolving how to share the burden of curbing man-made global warming, mainly because countries don't agree on who is rich and who is poor.

China wants to maintain a decades-old division between developed and developing countries, bearing in mind that, historically, the West has released most of the heat-trapping gases that scientists say could cause catastrophic changes in climate.

But the U.S. and Europe insisted during the two-week talks in Bonn that the system doesn't reflect current economic realities and must change as work begins on a new global climate pact set to be completed in 2015.

"The notion that a simple binary system is going to be applicable going forward is no longer one that has much relevance to the way the world currently works," U.S. chief negotiator Jonathan Pershing said.

Countries like Qatar and Singapore are wealthier than the U.S. per capita but are still defined as developing countries under the classification used in the U.N. talks. So is China, the world's second largest economy.

Finding a new system that better reflects the world today, while also acknowledging the historical blame for greenhouse gas emissions, is the biggest challenge facing the U.N. process as it seeks a global response to climate change.

"That is a fundamental issue," said Henrik Harboe, Norway's chief climate negotiator. "Some want to keep the old division while we want to look at it in a more dynamic way."

The U.N. climate talks are based on the premise that industrialized countries must take the lead on climate change by committing to reducing emissions of carbon dioxide and other greenhouse gases. They are also expected to provide money to help poor countries grow in a sustainable way and to protect the most vulnerable nations from rising sea levels, droughts and other consequences of a warming world

Disputes on how to categorize countries going forward was behind much of the procedural wrangling that slowed down the talks in Bonn. Delegates failed to agree on an agenda until the last day, leaving most of the work for a bigger summit in Qatar in November.

A separate dispute between developing countries delayed the appointment of officials to steer the talks. That stalemate was also unlocked on the last day.

The slow pace frustrated climate activists who fear that there won't be enough political will to rein in emissions to avoid dangerous levels of warming in coming decades.

"The talk here doesn't match the action that science says is required," said Mohamed Adow, senior climate change adviser at Christian Aid.

China's lead negotiator Su Wei told The Associated Press that the proposed new deal, which would have binding commitments for all countries after 2020, must be based on the principle of "common but differentiated responsibility" enshrined in previous climate agreements.

"That means we still would continue the current division between developed and developing countries," Su said.

He said China is still a developing country because if you look at wealth per capita, it barely makes the world's top 100. More than 100 million Chinese live below the poverty line, which Beijing has defined as about $1 a day.

Still, Western officials say China's fast-growing energy needs and rising emissions mean it can no longer be off the hook in climate negotiations.

"We need to move into a system which is reflecting modern economic realities," EU negotiator Christian Pilgaard Zinglersen said.

In the early 1950s, China accounted for just 2 percent of global emissions while the U.S. accounted for more than 40 percent, according to Climate Analytics, a climate research group based in Potsdam, Germany.

Today China's share of global emissions exceeds 25 percent, while the U.S. share has fallen toward 20 percent.

China and its supporters reject blame for stalling the climate talks, saying it is the U.S. and other developed nations that are unwilling to live up to their obligations to cut carbon emissions.

The U.S. refused to join the only binding accord to limit emissions ? the 1997 Kyoto Protocol ? partly because it didn't include China.

Seyni Nafo, spokesman for a group of African countries in the climate talks, noted that the U.S. also said that joining Kyoto would harm the U.S. economy. Years later, the U.N. climate effort still has little support in the U.S. Congress, which includes outspoken climate skeptics.

"We are hoping that they will get on board this time, which is not a given," Nafo said.

Google Analytics Opt-out Add-on for Chrome

Many websites and services make use of Google Analytics, a web statistics service that is tracking web users on websites where the script is installed. Besides the tracking, there is also the aspect of loading times that are affected by the script. Web users who do not want to be tracked, or want sites to load faster, may want to consider blocking the Google Analytics script from running on sites they visit.

Firefox users can use the excellent NoScript add-on for that, which takes care of both issues. Chrome users can install comparable solutions like NotScript or ScriptNo. Some may however feel that they interfere to much with day-to-day web browsing.

blocked-google-analytics

The Google Analytics Opt-out Add-on for the Chrome browser may not be the perfect solution, as it only tackles the tracking problem but not the loading of the script itself, but it does not interfere with other scripts running on the site. The Chrome extension has been created by Google, which may be the reason why the script is not blocked outright. According to information posted on the Chrome Web Store, the add-on ?communicates with the Google Analytics JavaScript (ga.js) to indicate that information about the website visit should not be sent to Google Analytics?.

It basically means that the script is loaded, and that the add-on notifies the script that the visit should not be tracked.

Another solution that is working universally on the system would be to block Google Analytics in the hosts file. Simply add the following two lines to your hosts file:

  • 127.0.0.1 www.google-analytics.com
  • 127.0.0.1 ssl.google-analytics.com

On Windows, the hosts file is located in the C:\Windows\System32\drivers\etc directory. Just open it in a plain text editor like Notepad, and add the two rows to the end of it. This basically redirects requests that websites make to Google Analytics servers to the local system where the script can?t be found. Webmasters should keep in mind that this may prevent them from accessing the Google Analytics website.

Pablo Larrain's No Wins Cannes' Director's Fortnight Prize

Gael Garcia Bernal in "No."

Well, that was a, uh, no-brainer. As Cannes winds down, its numerous awards start getting doled out -- and the most notable win so far comes for Pablo Larrain's critics' darling "No," which has just taken the Art Cinema Award, the top prize in the festival's Directors' Fortnight sidebar.

The film, a riveting political campaign drama starring Gael Garcia Bernal, was the obvious favorite for the award from its first screening way back on the third day of the festival, where it received rapturous applause and prompted many to ask why it wasn't in a higher-profile strand of the festival. Since then, it's had pretty much a dream festival run: reviews were glowing across the board, while word of mouth spread rapidly from that first screening, inspiring many more Competition-focused critics to give it some column inches.

Most thrillingly, US art-film powerhouse Sony Pictures Classics acquired the distribution rights a few days ago, assuring it a wider release than any of Larrain's previous films and significantly upping its chances of Oscar attention -- providing, of course, that Chile submits it to the Academy. All in all, a spectacular outcome for a film that might not have gotten its due in Competition -- though you can bet the selectors won't be caught napping the next time Larrain brings a film their way.

I haven't been able to dig into Directors' Fortnight as much as I'd have liked to this year, though I understand from colleagues that it was a stronger-than-average lineup. Still, nothing has eclipsed "No" as the breakout story of this year's festival sidebars, so the award feels appropriate. The film remains one of my two favorites of the entire festival -- if you'll forgive the smugness, I'm pleased I listed it as one of my five most anticipated titles before Cannes kicked off. ?

In other awards news, veteran Algerian director Merzak Allouache's "The Repentant," a reportedly deeply moving drama about Islamic fundamentalism, won the Best European Film prize in Directors' Fortnight. (Before you complain that Algeria isn't in Europe, it's a French production.) Cannes regular Nuri Bilge Ceylan took the Fortnight's Carosse d'Or award, a career achievement prize of sorts.

Meanwhile, over in the Critics' Week sidebar -- far less talked-about than the Fortnight this year, largely due to the prevalence of first-time filmmakers in its lineup -- Spanish emigration drama "Here and There," about a Mexican migrant worker returning home after many years in the US, took the Grand Prize, which went to Jeff Nichols's "Take Shelter" last year.

Lesser awards in the same strand went to "Sofia's Last Ambulance," a comic documentary about paramedics in the Bulgarian capital, Israeli theological thriller "God's Neighbours" and Argentinian juvenile-delinquent drama "The Wild Ones."

Romney opens new front vs Obama: schools are failing

WASHINGTON (Reuters) - Republican presidential candidate Mitt Romney opened a new front on Wednesday in his fight against President Barack Obama, accusing him of presiding over a failing U.S. education system in the grip of union bosses who refuse to accept reforms.

In a rare diversion from his campaign focus on the weak U.S. economy, Romney laid out an education plan in a speech that represented his most overt appeal to date to Hispanic voters who have largely sided with the Democratic incumbent.

Although he trails Obama by a huge margin among Hispanics, Romney's address to a Hispanic business group avoided mentioning a top priority for them: how to overhaul the country's immigration system.

Romney said millions of American children are getting a "third-world education" and offered proposals that he said would reward teachers for their results instead of their seniority. And he would give parents greater choice of where to send their children to school and take other steps to reduce the influence of powerful teachers' unions.

"I believe the president must be troubled by the lack of progress since he took office. Most likely, he would have liked to do more. But the teachers unions are one of the Democrats' biggest donors - and one of the president's biggest campaign supporters. So, President Obama has been unable to stand up to union bosses - and unwilling to stand up for kids," Romney said.

Meanwhile, at a rally in Denver, Obama kept up criticism of his opponent's record as a job-cutting business executive - a prime target for the president and his re-election campaign.

"I think he has learned the wrong lessons," Obama said, pressing a populist attack on what he called Romney's bad ideas for the U.S. economy.

"His working assumption is if CEOs, and wealthy investors like him get rich, the rest of us automatically will too," he said.

There has been increasingly heated rhetoric between the two in recent days over Romney's time as the head of the corporate buyout company Bain Capital.

Obama made only a brief mention of education, repeating his plans to enhance ties between community colleges and businesses and saying his goal was that "by the end of this decade more of our citizens hold a college degree than any other nation on Earth."

Romney's pivot to education comes during a battle in Washington over student loan programs. Obama's Democrats are pushing for extending low-interest loan rates for federal loans to avoid a doubling of the rates from 3.4 percent. A compromise with Republicans is expected by the July 1 deadline.

The former Massachusetts governor is neck-and-neck with Obama in polls, a prelude to what could be a close election.

HISPANICS AND EDUCATION

Hispanics will likely be crucial to the election.

A Wall Street Journal/NBC/Telemundo poll showed Obama leading Romney with Hispanic voters 61 percent to 27 percent. Romney is only now starting a push to try to peel some of them away because of their potential influence in swing states like New Mexico, Florida, Colorado, Virginia and North Carolina.

But Romney went almost an hour at his event without mentioning the U.S. immigration system and how he would deal with 12 million illegal immigrants in the United States.

In the Republican primary battle, Romney and his rivals upset many Hispanics by adopting hardline immigration positions. Romney called for the "self-deportation" of illegal immigrants.

On Wednesday he stuck to education, also a top issue for Hispanics but one that rarely ignites passion in the campaign.

In the meantime, Obama, whose re-election largely hinges on what happens with the fragile economy and high unemployment, accused Romney's Republicans of "bamboozling folks into thinking that they are the responsible, fiscally disciplined party."

Seeking to counter Republican charges of wasteful spending, Obama insisted that the rate of spending has grown less under Democratic than under Republican administrations.

Hispanic Republican strategists said Romney was wise to keep his focus on education and the economy, noting that in several polls, Hispanic voters rate the economy well ahead of immigration as the issue they care about most.

"Clearly, it appears that Governor Romney has chosen to focus on what the vast majority of U.S. Hispanics and Latinos feel is of highest priority," said Daniel Garza, from The Libre Initiative non-profit group.

Standing before a banner that read "A Chance for Every Child," Romney laid out an education plan that relies heavily on bolstering and improving the No Child Left Behind education law engineered by Obama's Republican predecessor, George W. Bush.

Romney made more money and more access to charter schools the centerpiece of his platform, but he launched a strong attack on teachers' unions. "The teachers' unions are the clearest example of a group that has lost its way," Romney said.

"COME ON MITT, THINK!

The education speech was a welcome break for Romney, who has been under a barrage of accusations from Democrats that he killed blue-collar jobs when he was head of Bain in the 1990s.

Bain bought and restructured companies, sometimes resulting in a loss of jobs. But Romney says the company more than made up for that by helping to establish companies that became big employers, like office supplies store Staples.

He told Time magazine business experience gave him savvy to fix the economy and he welcomed scrutiny of his record. "The fact is that I spent 25 years in the private sector. And that obviously teaches you something that you don't learn if you haven't spent any time in the private sector," he said.

While Romney often polls ahead of Obama on the economy, the president's foreign policy credentials weigh in his favor compared to the ex-governor, who has little foreign experience.

Former U.S. Secretary of State Colin Powell criticized Romney for taking advice from foreign policy advisers who are "quite far to the right," in an sign of lingering strains from his tenure under President George W. Bush.

He made clear that he is not happy with some of the neo-conservatives who are advising Romney and took exception to a recent comment from Romney that Russia is the top U.S. geopolitical threat.

"Come on Mitt, think! That isn't the case," said Powell.

Small Businesses Success Depends Upon Many Factors to Keep ...

Fast Company offered up an insightful article about small business in the recently, ?The Really Big Guide of Small Business Success Tips.? This article offers some interesting insights as well as embedded videos from some of the tipsters quoted in the article.

It?s well worth a full viewing but here are some takeaways that we had. First, it is astounding that businesses with less than 500 employees are 99.7% percent of employer firms. That?s a big number so our resident information professional took a look at the numbers.? The Small Business Administration confirms this number and the Census Bureau gives us a different view based on 2008 numbers.

The scary number comes from the Bureau of Labor Statistics, nearly half of small businesses do not make it to year five.? A few tips offered in this article include, take a risk but base it on good research.?

Perhaps the most striking advise is related to strategic plans.

?To stay nimble (and use it as a competitive advantage), Kaihan Krippendorff says new businesses in growth mode need to move away from strategic planning and concentrate on strategic thinking. There isn?t enough time or resources for such a small payoff. ?This doesn?t mean small-growth companies should fly blind. It means they should adopt an adaptive opportunistic approach to strategy. They should plan in the hallway, not the boardroom.??

And of course, they end the article on a note that resonated with us here at Workshop, the Creative Workplace. Thomas Edison?s words of encouragement should be heeded in small business. ?"Many of life?s failures are people who did not realize how close they were to success when they gave up."?

US assistance makes Yemen an inviting terror target

Officials have said the attack is likely the work of al-Qaida. The terrorist network has grown in Yemen because the country hasn't had an effective government for an entire year. NBC's Richard Engel reports.

By Robert WindremNBC News

A terror attack Monday on a Yemeni military parade that killed scores occurred amid increasing cooperation between the Yemen and U.S. governments, with the latter stepping up assistance to the Yemeni military and regularly targeting purported terrorist cells with drone strikes.

The cooperation reflects a growing? belief in U.S. national security circles that al-Qaida in the Arabian Peninsula (AQAP), the Yemeni al-Qaida affiliate, is now a bigger and more dangerous threat than the central al-Qaida group in Pakistan.

The cooperation is not limited to counter-terrorism. The U.S. is openly helping the new Yemeni government in counterinsurgency efforts against an AQAP-affiliated group, Ansar al-Sharia, in the south of the country. ?The assistance includes ?a small contingent? of military trainers and intelligence officers assisting the Yemeni forces.

The presence of the American personnel in Yemen is raising concerns that Washington risks opening another front in the war against al-Qaida before it has fully extricated itself from long, bloody conflicts in Afghanistan and Iraq.

But a senior U.S. counterterrorism official, who spoke with NBC News on condition of anonymity, said the AQAP?s successes in recent months give Washington little choice but to increase support for the new Yemeni government of President Abd-Rabbu Mansour Hadi.

?AQAP?s enhanced footprint in southern Yemen increases the chances that the group will establish a regional safe haven,? said the official.??This would be a dangerous development because AQAP?s anti-government fight and its terrorist plotting against the West are its two main goals.?Unless its gains are reversed, AQAP will have more flexibility to conduct external attacks from a position of strength.?

The Yemeni government position is about survival. Like Tunisia, Libya and Egypt, Yemen is under new management, after former President Ali Abdullah al-Saleh?s replacement by Hadi, his former deputy, in February.

Hadi?s position is precarious. Ansar al-Sharia, an Islamist insurgent group, is trying to further destabilize the water-starved, tribal-riven state, with the ultimate goal of toppling his government.

'Massacre" as suicide bomber targets military parade rehearsal in Yemen

But Hadi?s ?increasing reliance on U.S. help has likewise caused him some difficulties, triggering protests among middle- and upper middle-class Yemeni youth who are resentful over the U.S. role in the country, particularly the drone strikes and surveillance.

Mohammed Huwais / AFP - Getty Images

Yemeni military police collect evidence at the site of a suicide bomb attack in Sanaa on Monday, which killed nearly 100 members of a Yemeni army battalion

Michael Leiter, former director of the National Counter Terrorism Center and now an NBC News analyst, said the deaths of nearly 100 Yemeni soldiers in Monday?s bombing are likely to bring two countries? counter terrorism efforts closer.

?Hadi's rise has probably brought greater legitimacy to cooperation with the U.S.,? said Leiter. ?? The president (Hadi) and elements of the security and defense establishment cooperate with the U.S. but want to keep that relatively quiet in order to avoid enflaming the domestic population.? .. . And, frankly, with horrific attacks like today, U.S. assistance often becomes more rather than less welcome.?

A Yemeni official, also speaking on condition of anonymity because he is not authorized to speak with the press on security operations, contended that ??broad cooperation? with the U.S. is necessary and marks a ?new level? of friendly relations between the two countries. He said the U.S. role in Yemen is limited in terms of numbers, but significant in helping the government turn back Ansar al-Sharia, which he characterized as ?militants, drug dealers and foreign groups.?

'Intelligence, satellite images and technical advice'
?The U.S. is providing intelligence information, satellite images and technical advice? valuable in both ?counterterrorism and counterinsurgency efforts, said the official. Both the U.S. intelligence community and the Joint Special Operations Command, JSOC, are involved. He emphasized there are ?no boots on the ground? fighting with Yemeni forces.

Neither the U.S. nor Yemeni official would put numbers on the U.S. involvement. Nor would the Yemeni? deny the presence of CIA officers on the ground.

The most high profile product of this cooperation has been the drone attacks on both counterterrorism and counterinsurgency targets. High profile attacks have killed three top AQAP officials in the past eight months, but there also have been an increasing number of attacks on lesser figures and even suspected gatherings of terrorists. The attacks, said the Yemeni official, have taken place ?all over the country.?

In September, apparently helped by material uncovered in Osama bin Laden?s compound in Pakistan, U.S. drones killed two American citizens in Kashef, about 85 miles east of the capital, Sanaa. The dead were Anwar al-Awlaki, an AQAP leader blamed for recruiting other Americans to the group?s violent cause, and Samir Khan, co-editor of ?Inspire,? a magazine whose articles included ?How to Make a Bomb in the Kitchen of Your Mom.?

Then, earlier this month, the director of AQAP?s external operations, Fahd al Quso, was similarly killed by a drone attack in a remote mountain valley -- his whereabouts reportedly exposed by a British-Saudi-U.S. undercover intelligence operation. The penetration of AQAP by an informant ?also resulted in the interception of a new, more sophisticated ?version of the underwear bomb previously used unsuccessfully? to try to down U.S. airliners. (Yemeni intelligence, said the Yemeni official, had ?no role? in that operation and was unaware of it.)

By some estimates, the tempo of the drone strikes against AQAP and Ansar al-Sharia is now even greater than in Pakistan, with the number of attacks in May surpassing even the most intense month of attacks against al-Qaida central in Pakistan. According to the ?Long War Journal? website, which uses local reporting to track Predator strikes, 30 AQAP fighters (and seven civilians) have been killed in five drone strikes in the past 10 days alone. (Both U.S. and Yemeni officials say that such local reports are often inaccurate or exaggerated.)

The larger concern in terms of U.S. involvement may be the counterinsurgency effort. The Los Angeles Times reported? last week that at least 20 U.S. Special Operations troops are using satellite imagery, drone video, eavesdropping systems and other technical means to help pinpoint targets for the Yemeni military offensive that?s currently under way in the south.?

The Yemeni official would only say that targeting is ?very selective? and that ?No Americans are fighting on the side of the Yemenis,? a point on which U.S. officials agree.

While the Yemeni official said the offensive has made great strides recently, there have been setbacks, including the killing of 32 Yemeni soldiers on May 7 when AQAP overran a Yemeni position. That was the deadliest single encounter for government forces in the war with AQAP until Monday?s attack.

The Yemeni official said that the public is supportive of both operations, despite a social media protest by the country?s youth that has drawn some attention.

He claimed that no civilians have been killed in the drone strikes and stated that that care has been taken to strike at times and places where only AQAP and its allies are present.

There?s no doubt that U.S. cooperation -- and the drone strikes?will continue. The U.S. wants to kill Ibrihim Hassan Al-Asiri, the AQAP?s expert bomb-maker, before he trains others in his craft.?

But the mere presence of U.S. military personnel in the country carries risk of a confrontation that could quickly escalate. This weekend, for example, a local Yemeni newspaper reported unidentified gunmen opened fire on a car that belonged to U.S. military trainers as they left the tourist al-Hodeida Land Resort in the western part of the country. None of the Americans were believed to have been injured.
